TERMS OF SERVICE
1. Who we are and what these Terms cover
This website is operated by Millclock “we”, “us”, “our”).
These Terms of Service (“Terms”) govern:
- your access to and use of our websites and online store;
- any purchase of products made through our store.
By visiting the site or buying something from us, you agree to be bound by these Terms and by any other policies we refer to on the site (such as our Privacy Policy and Return Policy). If you do not agree, please do not use the website.
We may update these Terms from time to time. The latest version is always available on this page. Your continued use of the site means you accept the updated Terms.
2. Using our website
By using our site, you confirm that:
- you are at least the age of majority in your country or have permission from a parent/guardian;
- you will not use the site or our products for any unlawful or unauthorised purpose;
- you will not try to damage or disrupt the website (for example by sending malware, spam or harmful code).
We may suspend or stop providing access to the site or store to anyone who violates these Terms or misuses our services.
3. Orders, prices and payment
All prices, product details and availability shown on the site may change at any time without prior notice.
Placing products in your cart does not create a binding contract. A contract is formed only when we confirm your order (usually by a separate order/shipping confirmation email).
We reserve the right to refuse or cancel any order (for example, in case of suspected fraud, obvious errors, or stock issues). If payment has already been made, we will refund it.
You agree to:
provide correct and complete billing, shipping and contact information, and
keep this information up to date so we can process your order and contact you if necessary.
Payments are processed via third-party payment providers. We do not store your full card details on our own servers.
4. Products, handmade nature and returns
We specialise in Nixie tube clocks and related products. Many items are handmade or produced in small batches, which means:
- slight variations in colour, finish or appearance are normal and not considered defects;
- product photos are illustrative and may differ slightly from the actual product.
Some products may be available only online and in limited quantities.
Returns, exchanges and cancellations are handled according to our Return Policy, which is part of these Terms. Please read it carefully before ordering.
5. Accuracy of information
We aim to keep product descriptions, prices and other information accurate, but mistakes can happen.
We may correct errors, update information or cancel orders if we discover that something on the site was inaccurate, even after you have placed an order. We do not promise that all information on the site is always complete, current or error-free, and you use the information at your own risk.
6. Third-party services and links
We use third-party services to run our store (for example hosting, payments, shipping, analytics, email).
These providers may have their own terms and privacy policies, which apply in addition to ours.
Some providers may be located in other countries, so your data and transactions may be subject to the laws of those jurisdictions.
Our site may contain links to third-party websites. We are not responsible for their content, products, services or privacy practices. Any dealings with those sites are solely between you and the third party.
7. User content (reviews, comments, ideas)
If you send us reviews, photos, suggestions, ideas or other materials (“content”), you agree that we may:
use, edit, publish, translate, distribute and display that content in any media,
without obligation to pay you or keep such content confidential.
You are responsible for what you submit and you agree that your content:
- does not infringe any rights of others (e.g. copyright, trademark, privacy);
- is not illegal, abusive, defamatory, obscene or otherwise inappropriate;
- does not contain malware or harmful code.
We may remove or edit user content if we believe it violates these rules, but we are not obliged to monitor everything that is posted.
8. Prohibited behaviour
In addition to other restrictions in these Terms, you agree not to use the site:
- for any illegal purpose or to encourage others to break the law;
- to violate intellectual property rights (ours or those of others);
- to harass, threaten, insult or discriminate against anyone;
- to send false or misleading information;
- to upload viruses, malware or any code meant to interfere with the site or other systems;
- to collect personal data of other users without their consent;
- for spamming, scraping or other abusive automated activity.
We may block or terminate your access if you engage in prohibited uses.
9. Warranties and liability
The website, the Service and all products are provided “as is” and “as available”, except where we expressly state otherwise (for example, in a written warranty for a specific product).
To the maximum extent permitted by law:
- we do not give any guarantees regarding uninterrupted, secure or error-free operation of the website;
- we are not liable for any indirect, incidental, special or consequential damages, including lost profits, lost data or replacement costs, arising from your use of the site or our products.
Where the law in your country does not allow certain limitations, our liability will be limited to the maximum extent permitted by that law and, in any case, generally not exceed the amount you paid for the product concerned.
Nothing in these Terms limits liability where it would be unlawful to do so (for example, for fraud or personal injury caused by our negligence).
10. Indemnity
You agree to indemnify and hold harmless Millclock, its owners, employees and partners from any claims, damages, losses, costs or expenses (including reasonable legal fees) arising from:
your breach of these Terms; or
your violation of any law or third-party rights when using our site or products.
11. Termination
You may stop using the site at any time.
We may suspend or terminate your access to the site or Service, without notice, if:
you breach these Terms, or
we reasonably suspect misuse or fraudulent activity.
Termination does not affect any obligations or liabilities that arose before the termination date (for example, payment obligations).
12. Governing law
These Terms and any disputes arising out of or in connection with them are governed by the laws of Ukraine, without regard to conflict of law rules.
If you are a consumer in the EU/EEA or UK, you may also benefit from the mandatory consumer protection laws of your country of residence.
13. Changes to these Terms
We may revise these Terms from time to time. The updated version replaces all previous versions once it is posted on this page.
Your continued use of the website after changes are posted means you accept the updated Terms.
